Chicago, IL A longtime asbestos worker is suing tens of businesses over allegations that exposure to asbestos from his birth until retirement caused him to suffer malignant mesothelioma, a deadly cancer caused by inhalation of asbestos particles.
Robert Koohy has filed a suit on 17th July in the circuit court of Cook County in Chicago, IL. He says he suffered personal direct asbestos exposure as well as secondary exposure.
The complaint states that Koohy worked at different jobs from 1961 until 1978. During this period, he came in touch asbestos products used, manufactured, transported or marketed by the defendant companies. According to the lawsuit, Koohy also suffered secondhand exposure to asbestos through the work clothing of his father between 1942 and 1961, and while serving the United States Navy between 1961 and 1978.
On 18th August, 2014, according to the suit, Koohy was diagnosed with malignant mesothelioma.
Mesothelioma, a cancer of the mesothelium, is developed when the mesothelial cells become abnormal and start dividing without any order or control. Cancer cells might metastasize from their initial site to various other body parts. Mesothelioma cases mostly start in the pleura. It may also begin in the peritoneum or pericardium.
Mesothelium is the membrane which lines and protects the internal body organs and is composed of 2 layers of cells. One of them covers the organ immediately and the other one forms a protective sac around it. Mesothelium produces a fluid which is released between the two layers. This allows organs to easily glide against nearby structures (such as contraction and expansion of lungs and the beating of heart).
Based on the position in the body, mesothelium has been given different names. The mesothelial tissue covering the organs of abdominal cavity is called peritoneum and the cancer affecting this tissue is known as peritoneal mesothelioma. The membrane which covers and lines the lungs and the wall of chest cavity is called pleura and the tumor affecting this membrane is known as pleural mesothelioma. The protective membrane covering the heart is known as pericardium and the mesothelioma affecting pericardium is called pericardial mesothelioma. The mesothelial membrane that surrounds the internal reproductive organs in males is known as tunica vaginalis testis and the cancer affecting this tissue is called testicular mesothelioma. Mesothelioma could also affect the tunica serosa uteri that cover the internal female sex organs.
Koohy is seeking compensatory damages in excess of the jurisdictional limits of the court, in addition to costs.
